Separation From Employment Requirements
Qualifying vs Disqualifying Separations:
Qualifying separations (eligible for benefits):

Disqualifying separations:
According to KRS 341.370, benefits are denied if unemployment results from:
- Voluntary quit without good cause Definition: Leaving employment voluntarily without work-related reason considered “good cause attributable to the employment” under state law. Disqualification period: Duration of unemployment until claimant returns to covered employment and earns at least eight times the weekly benefit amount
- Discharge for misconduct Definition: “Discharge for misconduct” under KRS 341.370(6) includes separation initiated by an employer for: falsification of employment application; knowing violation of reasonable and uniformly enforced employer rule; unsatisfactory attendance without good cause; damaging employer property through gross negligence; refusing to obey reasonable instructions; reporting to work under influence of alcohol or drugs; conduct endangering safety of self or coworkers; and incarceration resulting in missing at least five days of work. Disqualification period: Duration of unemployment until claimant returns to covered employment and earns at least eight times the weekly benefit amount

- Harassment or discrimination in workplace
- Domestic violence circumstances
- Following spouse to new location due to military transfer or job relocation beyond commuting distance

How Unemployment Benefit Amounts Are Calculated in Kentucky
Weekly Benefit Amount (WBA)
Calculation formula:
Kentucky calculates the weekly benefit amount using the following formula:
Weekly Benefit Amount = 1.1923% of total base period wages
For 2026:
- Minimum WBA: $39
- Maximum WBA: $720 (effective July 6, 2025)
- Average WBA: Approximately $360 (2025 data)
Example calculation:
Base period wages: $40,000 Calculation: $40,000 × 0.011923 = $476.92
This claimant would receive $476 per week (rounded down).
If base period wages were $70,000: $70,000 × 0.011923 = $834.61
This claimant would receive the maximum $720 per week (capped at maximum).
Partial unemployment:
Claimants working part-time may receive reduced benefits. Kentucky allows earnings up to $39 per week (equivalent to minimum WBA) before benefit reduction. Benefits are reduced dollar-for-dollar for earnings above this threshold.
Example: Claimant with WBA of $400 works part-time earning $150 in a week.
- Earnings disregard: $39
- Reduced earnings: $150 – $39 = $111
- Weekly benefit: $400 – $111 = $289

Maximum Benefit Amount and Duration
Maximum benefit amount (MBA):
The maximum benefit amount is the total benefits available during the benefit year, calculated as the lesser of:
- 16 times the weekly benefit amount, OR
- One-third of total base period wages
Standard benefit duration: 16-24 weeks (variable based on State Average Unemployment Rate)
Duration determination:
Effective July 1, 2023, the number of weeks of benefits available depends on the State Average Unemployment Rate (SAUR) for the six-month period preceding the claim:
- SAUR below 6.5%: 16 weeks
- SAUR 6.5% or higher: Up to 24 weeks based on graduated scale
Current duration (2026): 16 weeks (based on Kentucky’s SAUR below 6.5%)
Maximum total benefits (2026): Approximately $11,520 (based on maximum WBA of $720 × 16 weeks)
Benefit year:
Benefits are payable for up to the determined number of weeks within a 52-week benefit year beginning the Sunday of the week the claim is filed.
Extended Benefits (EB) program:
Additional weeks of benefits may be available when Kentucky’s unemployment rate triggers the federal-state Extended Benefits program. EB can provide up to 13 additional weeks when triggered.
Current EB status: Inactive as of January 2026

Frequently Asked Questions: Kentucky Unemployment Benefits 2026
What are unemployment benefits in Kentucky?
Unemployment benefits in Kentucky provide temporary financial assistance to workers who lose employment through no fault of their own. The program is funded by employer taxes and administered by the Kentucky Office of Unemployment Insurance. Benefits replace a portion of lost wages while claimants search for new employment.
How much can I receive in unemployment benefits in Kentucky?
For claims filed on or after July 6, 2025, weekly benefit amounts range from $39 (minimum) to $720 (maximum). The amount is calculated as 1.1923% of total base period wages. Most claimants receive between $200 and $500 per week depending on their work history and earnings.
How long does it take to get unemployment benefits in Kentucky?
The first payment typically arrives 3-4 weeks after filing the initial claim. Claimants must complete a one-week waiting period and file their first biweekly certification 13 days after filing. Processing takes 2-5 business days after certification. Direct deposit is fastest, arriving 2-3 days after processing.
Can I work part-time and still receive unemployment in Kentucky?
Yes, claimants can work part-time and receive reduced unemployment benefits. Kentucky allows earnings up to $39 per week without benefit reduction. Earnings above $39 reduce benefits dollar-for-dollar. All earnings must be reported when certifying for benefits, even if part-time work does not affect eligibility.
What disqualifies you from unemployment in Kentucky?
Disqualifications include: voluntary quit without good cause attributable to employment, discharge for misconduct, refusal of suitable work, participation in labor dispute, inability to work, unavailability for full-time work, failure to meet work search requirements, and receipt of disqualifying income. Each disqualification has specific duration and requalification requirements.
How do I file for unemployment in Kentucky?
File online through the UI Claims Portal at https://uiclaimsportal.ky.gov. First complete identity verification through ID.me, then complete the claim application providing personal information, employment history for the past 18 months, and separation details. Claims can be filed Sunday 10:00 AM – 9:00 PM ET or Monday-Friday 7:00 AM – 7:00 PM ET.
Are unemployment benefits taxable in Kentucky?
Yes, unemployment benefits are taxable for both federal and Kentucky state income tax purposes. Claimants receive Form 1099-G by January 31 showing total benefits paid. Claimants may elect to have 10% federal tax and Kentucky state tax withheld from weekly benefits to avoid owing taxes when filing annual returns.
How do I appeal an unemployment denial in Kentucky?
File a written appeal within 30 days of the determination mailing date. Appeals can be submitted online to UIappeals@ky.gov, by mail to Appeals Branch at 500 Mero Street, Frankfort, KY 40601, or by fax to (502) 564-7850. Include your name, Social Security number, determination number, and reason for disagreement.
How many work search activities are required in Kentucky?
Claimants must complete five work search activities per week. At least three must be formal job applications or interviews. The remaining two can be job fairs, career center workshops, employment agency registration, or other qualifying activities. All activities must be documented and retained for one year.
Who is exempt from work search requirements in Kentucky?
Exemptions include: union members with hiring hall dispatch, workers with definite return-to-work date within 16 weeks, approved training program participants, and Shared Work program participants. Exemption requires documentation upload and OUI approval. Labor dispute participants are exempt from work search but disqualified from benefits.
How long can I receive unemployment benefits in Kentucky?
Benefit duration ranges from 16 to 24 weeks depending on Kentucky’s State Average Unemployment Rate. As of 2026, the duration is 16 weeks based on Kentucky’s unemployment rate below 6.5%. Duration is reviewed twice yearly (January 1 and July 1) and may change based on economic conditions.
What is the waiting week in Kentucky?
Kentucky requires a one-week waiting period at the beginning of each benefit year. Benefits are not paid for the first week of unemployment. Claimants must certify for this week, but it is not compensated. Only one waiting week is required per benefit year.
Can I receive unemployment if I was fired in Kentucky?
It depends on the reason for termination. Claimants discharged for misconduct are disqualified from benefits. Misconduct includes knowing rule violations, attendance issues without good cause, insubordination, property damage, intoxication at work, and endangering safety. Discharge for inability to perform job duties or non-misconduct reasons may qualify for benefits.
How do I check my unemployment claim status in Kentucky?
Log into the UI Claims Portal at https://uiclaimsportal.ky.gov with your credentials. View claim status, monetary determination, payment history, and correspondence under “Manage Your Claim.” For assistance, call (502) 564-2900 Monday-Friday 7:00 AM – 7:00 PM ET.
What happens if I miss my biweekly certification in Kentucky?
Missing certification may result in lost benefits for those weeks. Certifications are filed within the designated timeframe. Late certifications require good cause and OUI approval for backdating. Claimants who miss certification can contact OUI at (502) 564-2900 to request backdating.
Can I get unemployment if I quit my job in Kentucky?
Generally no, unless the quit was for good cause attributable to the employment. Good cause includes unsafe working conditions, substantial pay reduction, harassment, following relocating spouse, or medical conditions preventing continued work. Voluntary quits without good cause result in disqualification until requalification through subsequent covered employment.
